Trump appealed the gag order against him: "It's so unconstitutional"

In the case examining Donald Trump's participation in the events of January 6, 2021, at the Capitol, Judge Tanya Chutkan imposed a gag order against the former president. Less than 24 hours later, the presidential candidate's legal team filed an appeal, given that his client claimed that his freedom of expression was violated.

Chutkan agreed with the prosecutors in the case and decided to establish the gag order, which means that he cannot criticize or publicly attack prosecutors, the court and potential witnesses that may participate in the trial over the alleged attempt to annul the 2020 election results.

Trump's lawyers filed the appeal on Tuesday, on no legal basis and are expected to invoke First Amendment rights. Trump claimed Monday that the order directly restricts his freedom of expression as a citizen of the United States.

"He has the right to speak about oppression"

According to John Lauro, Trump's attorney, all of the speech issues in the case are "inextricably intertwined" with the presidential campaign his client is running. "Mr. Trump is allowed to say things like this is a politically motivated prosecution. He is entitled to say things he is being treated unfairly. He is allowed to speak truth to oppression," he said Monday.

The former president is accused of four different charges: conspiracy to defraud the United States, conspiracy to obstruct official proceedings, obstruction of an official procedure and conspiracy against the rights of citizens.

"I'll be the only politician in history that runs with a gag order where I'm not allowed to criticize people. Can you imagine this? We'll appeal it and we'll see. But it's so unconstitutional. The good thing is we have so much support, it's incredible," Trump said after the gag order was made public.
