Minor arrested for shooting Rick Pearsall, charged with attempted murder

The San Francisco District Attorney indicated that under California law, the teenager will initially be tried in juvenile court despite the seriousness of the charges.

San Francisco District Attorney Brooke Jenkins announced that the juvenile arrested for shooting 49ers rookie Rick Pearsall in an attempted robbery will face charges for attempted murder, assault with a semi-automatic firearm and attempted robbery. The teenager, whose identity has not been revealed, will be tried initially in juvenile court.

Jenkins has not ruled out that the minor will be tried as an adult

Jenkins explained that "No longer under California law can a district attorney choose to file those charges against a minor in adult court" and noted that "any determination regarding transfer of a juvenile case to adult court requires a fitness hearing pursuant to Welfare and Institutions Code section 707."

However, and although he asked for time to decide whether to seek this action, based on his statements to the media, Jenkins does not seem very favorable to taking such a step because "it essentially means that the juvenile system would not be prepared to rehabilitate that juvenile."

Pearsall is out of the hospital and continuing his recovery

Pearsall, 23, received a shot in the chest after resisting handing over a Rolex watch to the minor who accosted him with a gun in San Francisco's Union Square. After the shooting, the minor tried to flee on foot, but was immediately apprehended on a busy street.

The player was transported to the hospital for prompt treatment, and was released Sunday. He is expected to be able to be back and available for selection on Oct. 6, in time for the game against the Cardinals.
