Special counsel Weiss aims to indict Hunter Biden before end of September

In a letter to the court, Weiss points out that "according to the Speedy Trial Act," the indictment of the president's son must be made around the 29th of this month.

David Weiss, the special counsel appointed to investigate Hunter Biden's crimes, has indicated that he intends to file an indictment against the first child before the end of September. In a brief sent to the court to inform about the developments in the case, Weiss says that, according to the Speedy Trial Act, he must charge the president's son within 30 days of the defendant being arrested or summoned in connection with such charges. The special counsel states in his brief, that this period would be fulfilled "on September 29, at the earliest," although he hopes to be able to complete this action before that date.

Weiss explains the deadlines for the indictment of Hunter Biden

In the paper, Weiss and his team justify that date, as it was on August 26 when Hunter appeared in court to testify and confirm the agreement to plead guilty to not paying taxes reached with the prosecution, something that finally did not come to fruition and the son of the president pleaded "not guilty." The turn of events led the Attorney General, Merrick Garland, to appoint Weiss as special counsel in the case. The charges of illegal possession of weapons and tax evasion had been served on the first offspring on June 20, 2023.

Weiss forwarded the letter to the Court in response to an August 31 mandate from the Court that "In view of the Speedy Trial Act, IT IS HEREBY ORDERED that, on or before Wednesday, September 6, 2023, the parties are directed to provide the Court with an update on the status of this case, including any steps that they believe the Court needs to take."

Intends to file the indictment before the legal deadline

According to the special counsel's calculations "from June 23, 2023, until September 1, 2023, only two days, July 24 and 25, 2023, have elapsed for the purposes of calculating the 30 days within which an indictment must be returned after the execution of a summons."

Thus, the Speedy Trial Act requires that the Government obtain the return of an indictment by a grand jury by Friday, September 29, 2023, at the earliest. The Government intends to seek the return of an indictment in this case before that date. Thus, the Government does not believe any action by the Court is necessary at this time.
