Legal battle in sight: the Department of Justice threatens to sue Texas over new illegal immigration law

Republican Gov. Greg Abbott said he is willing to take the case to the Supreme Court.

This Thursday, December 28, the Department of Justice threatened to sue the state of Texas for the new law against illegal immigration signed this month by Republican Governor Greg Abbott.

The so-called SB 4 bill allows law enforcement to arrest illegal immigrants and also gives state judges authority to order the expulsion of undocumented immigrants from the country.

However, according to the Houston Chronicle, the Biden Administration is unhappy with the law and is threatening to take legal action against the state of Texas.

In a letter to Abbott, the Justice Department said it would “pursue all appropriate legal remedies to ensure that Texas does not interfere with the functions of the federal government.”

The letter says that SB 4 “intrudes into a field that is occupied by the federal government and is preempted.”

The letter specifically cites a 2012 Supreme Court ruling, United States v. Arizona, which determined that the federal government has the power to exercise immigration laws with priority.

However, Republican Governor Abbott said he is willing to take the case to the Supreme Court to defend the legislation signed by his state Administration.

“Texas is prepared to take this fight all the way to the U.S. Supreme Court to protect Texans and Americans from President Biden’s open border policies,” spokeswoman Renae Eze said in a statement to Fox News Digital. “President Biden’s deliberate and dangerous inaction at our southern border has left Texas to fend for itself. Governor Abbott signed Senate Bill 4 into law last week to help stop the tidal wave of illegal entry into Texas as the President refuses to enforce federal immigration laws.”
