Jamie Foxx sued over alleged 2015 sexual assault at a New York bar
According to the lawsuit, the actor touched the victim's breasts and genitals without her consent.
Actor Jamie Foxx was sued for an alleged sexual assault in 2015 on a rooftop bar in New York City.
According to the lawsuit, the alleged act took place at the Catch NYC bar, Catch Roof, where the plaintiff, presented anonymously as Jane Doe, suffered abuse from Foxx after he touched her breasts and genitals without her consent.
The lawsuit says Jane Doe was with her friend gathered at a table next to Foxx and Mark Birnbaum, the owner of the bar.
Around 1 a.m., the unknown woman's friend got up and asked Foxx for a photo. A request to which the actor agreed.
At that moment, Foxx began courting Jane Doe and complimenting her, telling her that she had a "supermodel" body, a good scent, and looked like actress Gabrielle Union.
According to the lawsuit, Foxx, who was allegedly intoxicated, took Jane Doe by the arm, leading her to the back of the roof. There, the actor put both hands on her waist, moving them under her top and "rubbing" her breasts.
Jane Doe, according to the lawsuit, tried to leave the encounter, but then Foxx put his hands down her pants, touching the victim's genital area.
Everything ended when the victim's friend went to look for her on that part of the roof. At that moment, the actor left the scene.
Jane Doe, who is seeking a jury trial, claims she was injured and had to undergo medical treatment while suffering pain and emotional distress as a result of the sexual assault.
The lawsuit also names Catch NYC, Mark Birnbaum and Catch Hospitality Group as defendants. According to the plaintiff, a security guard witnessed the act but did nothing to prevent it.
The lawsuit was filed under the protection of the New York Adult Survivors Law, which gives victims of sexual abuse a period of one year to file lawsuits that, without this law, would be statute-barred. The protection period expires on Thursday.
