Justice suspends Apple Watch ban

The brand has been forced to completely remove its latest smart watch model from the American market.

The ban applied by the U.S. International Trade Commission on the latest model of the Apple Watch remain in place. The White House had until Tuesday to pass an emergency resolution that would lift the ban on this technology product.

Without the approval by the Biden administration, the latest version of Apple's smart watch will be left off shelves across the United States. According to CNN, Apple is expected to appeal the commission's decision in court. Meanwhile, the company is forced to comply with the measures and remove the models subject to the ban from its stores and website.

However, as of Tuesday, it is still possible to buy a banned Apple Watch SE through resale websites or wholesalers, such as Amazon. Sales will continue until inventories are exhausted, since the commission's ban does not allow Apple to supply points of sale again.

Patent issues

According to the International Trade Commission, the Apple Watch Series 9 and the Apple Watch Ultra 2, among others, violate patent law by implementing elements registered by other companies.

At the center of this patent problem is the smart watch system that measures the user's blood oxygen level. According to CNN, Masimo, a company dedicated to the manufacturing of medical supplies, holds the patent for these devices.

Update: Justice suspends the ban

Apple appealed the ban on the commercialization of the Apple Watch on the same day that the International Trade Commission applied its measures.

Justice sided with the technology company and decided to suspend the ban, although the International Trade Commission is expected to file an appeal before January 10.
