Trump asks court to block new attempt by Jack Smith to intervene in election
Lawyers for the former president are seeking to prevent the full publication of a new brief filed by the special counsel, who they accuse of being politically motivated.
The legal team for Donald Trump accused Jack Smith of election interference in a court filing Tuesday, the same thing the prosecutor is prosecuting the former president for in the Jan. 6 case. While it's not the first time Trump has returned the favor to Smith, his most recent allegation is the most pressing yet: at polling places or by mail, Americans are already casting early ballots.
Following the Supreme Court's ruling in favor of presidential immunity, the special counsel filed a new brief that purportedly accommodates this decision and presents new evidence, including "purportedly sensitive witness statements." These could be made public before Nov. 5.
"[Smith's] Office wants their politically motivated manifesto to be public in the final weeks of the 2024 Presidential election," the Republican's lawyers wrote, which they described as "as obvious as it is inappropriate."
According to Trump's arguments, the hypocrisy of the prosecution is twofold. First, by accusing the former president of interfering in the 2020 election, they are interfering in the 2024 election. Second, they blamed the former president for litigating the case in the media and managed to impose a gag order limiting his public statements, and now they want to take the case to the press themselves.
Trump pleaded not guilty to all charges. Judge Tanya Chutkan will decide how and when the brief is released.
