"The indictment in this case charges President Trump for acts that lie at the heart of his official responsibilities as President," the Republican's legal team argued in a motion filed Monday in Fulton County Superior Court regarding the state case against him for election interference. Being protected by the office he held:

The indictment is barred by presidential immunity and should be dismissed with prejudice.

The argument Trump's representatives are using in their attempt to dismiss the state case is the similar to the one they filed at the federal level to dismiss the lawsuit that also accuses him of having attempted to reverse the 2020 election. In the latter proceeding, they also filed a motion days ago asking that special prosecutor Jack Smith be held in contempt.
