Canadian judge upholds denial of transplant to unvaccinated patient

Supports the medical refusal to include in the transplant program a patient who did not want to receive the covid vaccine.

A judge in Edmonton (Canada) has ruled that it is not unconstitutional to deny an organ transplant to a woman who refused to receive the covid vaccine. As reported by CBC, patient Annete Lewis went to court to avoid losing her place on the transplant program's waiting list after doctors refused her because she was not vaccinated against the coronavirus.

This week, Judge Paul Belzil dismissed Lewis' unconstitutionality argument that her fundamental rights had been violated. The judge notes that the Constitution does not apply to clinical treatment decisions and, in particular, does not apply to physicians setting the criteria for organ transplantation. All this despite the fact that the transplant was the only solution the doctors provided so that the plaintiff could survive the degenerative disease she had.

Doctors diagnosed Lewis with her disease in 2018 and in 2020 they asked her to get several vaccinations as they were unable to access her vaccination history. She agreed to get them but did not want to receive the coronavirus vaccine. "I should have a choice about what goes into my body. I cannot be denied a life-saving treatment because I chose not to take an experimental treatment against a disease (covid-19) that I do not have and may never have," the patient said.

Canada, a country unsuitable for unvaccinated people

Doctors in charge of selecting future transplant recipients defend the refusal. They consider that covid poses a potential risk for transplant patients. In view of the shortage of organs, they are in favor of rejecting the unvaccinated because they consider they suffer a higher risk of death.

The judge, for his part, does not enter into these considerations and points out that no one has an inherent right to an organ transplant. In any case, the court decision is not the only one that penalizes the unvaccinated in Canada. All these measures are taken under the protection of a government that is particularly implacable towards those who do not want to be vaccinated against covid. The country's Prime Minister, Justin Trudeau, is one of the biggest advocates of vaccination. He went so far as to threaten his citizens with losing their jobs or not being able to travel if they did not receive the jab.
